Abstract:	The willingness of Indonesia Government to develop Human Rights of its citizens which operated among other through legislative general elections, was not solely administrative activity but must in such a way take into consideration that operating the general election should not injury or defective the protection of citizens Human Rights in political as well as in legal field. Right to vote is a part of a comprehensive political system concept and also as legal right. Suffer from a loss of right to vote cripple the comprehensive political system, and disappear citizens legal right. Unused active right to vote means passive right to vote. Although perform an abstain choice, realizing right to vote in a free atmosphere society means realizing active right to vote.
