Abstract: Along with the development of increasingly secular, hedonistic, pragmatic and individualistic, has had an impact on some people who are now experiencing a shift in values and outlook on life. That influence is reflected in the idealism of thought that tends to ignore social norms and religious ties. The desire for more freedom in every way especially when freedom is correlated with the application of advanced science and technology, making them feel no longer be subject to and bound as a member of a group within the community. Even then became an autonomous individual, and may be freely questioned the tradition, moral, religious doubt. Finally, the concept of body and soul are also considered to be an absolute private property where a person is free to be able to do anything against the body and soul. Progress in the field of genetic engineering technology is a major influence on the development of the concept of freedom is because humans have been able to roam in areas that have long been regarded as the prerogative of God. Gene therapy now, can be utilized to minimize or even eliminate the possibility of birth defects under the fetus. Especially with the discovery of methods of cloning, the creation of duplicate living things can also be performed. The issue was whether the positive law in Indonesia can justify such freedom among the various interests of the dilemma. It is interesting to examine given the fundamental law of Indonesia on the one side is paying tribute to the efforts to develop science and technology but on the other side must also consider the ethical values, social, religious and legal.
