Abstract:	Policy in particular legislation regarding sanctions in criminal law the most important part because the existence can provide direction and consideration of what should be a sanction in a criminal act. However dual track systems so the application of the legislation showing much confusion, especially the shape and type of sanctions measures and types of additional sanctions. The policy establishes a criminal sanction as one means to handle crime is a matter of choice of many alternatives. Thus the selection and determination of criminal sanctions can not be removed from rational considerations and policies in accordance with the state and development of society. In the midst of a wave of sharp criticism and efforts to limit the use of imprisonment, then the policy of the legislature in determining the use of prison, it is clearly a central issue viewed from policy formulation at the level of legislation.
